Additional Terms and Conditions for PopCap Passport

The following additional terms and conditions set forth below apply to your participation and membership in the PopCap Passport Program:
1. The Passport program (the "Passport Program") is a rewards program offered to Members by PopCap Games, Inc. ("PopCap").
2. Eligibility: If you are at least 18 years old, you may become a Member in Passport Program by enrolling online at http://www.popcap.com. In order to activate your membership, you must provide PopCap with a valid email address and confirm your membership through a confirmation email, which is sent by PopCap to the email address you provided. Corporations, groups, associations or commercial customers and others purchasing items for resale are not eligible for membership in the Passport Program. Limit of one membership per individual applicant.
3. Membership. You must be a Member to receive Passport Program benefits or discounts. In order to become a Member you must agree to receive PopCap promotional emails, which will be delivered to the email address you have provided. No purchase is necessary to join the Passport Program. Passport Program benefits or discounts have no cash value, may not be purchased and are not redeemable for cash or a refund under any circumstances.
5. By enrolling in the Passport Program, the Member agrees to these PopCap Passport Terms and Conditions and any other Passport Program policies and procedures published on the PopCap.com website (collectively the "Passport Program Terms and Conditions"). Each Member shall be responsible for remaining knowledgeable as to the Passport Terms and Conditions and for periodically visiting PopCap.com to view any changes to the Passport Terms and Conditions. If the Passport Terms and Conditions are revised, the revised Passport Terms and Conditions will apply to all Passport members as of the date the revised Passport Terms and Conditions are posted to Popcap.com, including Members enrolled before the updated terms are posted.
6. PopCap may modify, alter, delete or add new Passport Program Terms and Conditions at any time without notice. This includes modifying, altering, adding or deleting program benefits, discount values, exclusive offers, conversion ratios and conditions for active status. These changes may affect a Member's discount level status or benefits already accumulated. PopCap may terminate the entire Passport Program, or any element of the Passport Program, at any time by announcement on its website, https://store.popcap.com/passport_login.php.
7. Termination of Membership by PopCap. Abuse of the Passport Program, including failure to follow the Passport Program Terms and Conditions, the sale or barter of benefits, product, promotional offers and any misrepresentation of fact relating thereto or other improper conduct as determined by PopCap in its sole judgment, may result in cancellation of the Member's account without notice and future disqualification from Passport Program participation, forfeiture of all benefits accrued (discount level status). PopCap reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorneys' fees and court costs in connection with PopCap's enforcement of the Passport Program Terms and Conditions. Passport Program benefits and rewards are subject to applicable government regulations and are void where prohibited by law. Members may have their membership revoked, if a Member's nickname (username) is deemed inappropriate or indecent, as determined by PopCap in its sole discretion. If there is no account activity (defined as an account profile update, purchases made) within a Member's account for two consecutive years (24 months), PopCap may, at its sole option, terminate your account and you will forfeit your discount-status level.
8. Termination of Membership by You. If you unsubscribe from the PopCap promotional emails, your Membership in the Passport Program will be terminated. To unsubscribe, please visit http://www.popcap.com/unsubscribe.php or send a written request to PopCap at:

9. Membership and benefits are nontransferable and may not be assigned to anyone including Member's estate, their successor or assignees. Enrollment becomes effective and acceptance of the Passport Program Terms and Conditions begins when a new Member enrolls in the Passport Program.
