THIS SWEEPSTAKES IS OFFERED IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA (D.C.), CANADA (EXCEPT QUEBEC) AND THE UNITED KINGDOM; THIS SWEEPSTAKES IS VOID ELSEWHERE AND WHEREVER PROHIBITED BY LAW. THIS SWEEPSTAKES SHALL BE CONSTRUED AND EVALUATED IN ACCORDANCE WITH ALL APPLICABLE LAWS AND REGULATIONS. THIS SWEEPSTAKES IS OPEN SOLELY TO PERSONS WHO ARE LEGAL RESIDENTS OF, AND CURRENTLY RESIDING IN, ONE OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA, CANADA (EXCEPT QUEBEC) OR THE UNITED KINGDOM AND WHO ARE AT LEAST 18 YEARS OF AGE (19 YEARS OF AGE IF A RESIDENT OF THE STATES OF ALABAMA OR NEBRASKA) WITH AN ACTIVE AND VALID E-MAIL ADDRESS AT TIME OF ENTRY.

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE AN ENTRANT'S CHANCES OF WINNING A PRIZE. INTERNET ACCESS IS REQUIRED TO ENTER.

PopCap Games, Inc. ("Sponsor") is offering this Sweepstakes ("Sweepstakes"). David Kessler & Associates, Inc. ("Administrator") is administrating the operation of, and prize fulfillment under, this Sweepstakes. Sponsor and Administrator shall be referred to collectively as the "Sweepstakes Entities".

This Sweepstakes is open solely to legal residents of the 50 United States and the District of Columbia ("D.C."), Canada (excluding residents of Quebec) and the United Kingdom who (a) presently are located and living in one of the eligible jurisdictions listed above, (b) are 18 years of age or older (19 or older if a resident of Alabama or Nebraska) as of the time of entry, and (c) have an active and valid e-mail address as of time of entry. The Sweepstakes is void in Quebec, outside the eligible jurisdictions listed above, and wherever prohibited by law. Employees of Sponsor and Administrator, their respective parent companies, affiliates, subsidiaries, promotion, agents, marketing and advertising agencies, and certain other companies with which Sponsor does business such as, but not limited to, Worldwinner/GSN, King.com, Wild Tangent and Wetpaint, and members of the immediate families (defined for these purposes as including parents, spouses, children, siblings, grandparents, grandchildren, aunts and uncles, and each of their respective spouses, regardless of whether living in the same household) or households (regardless of whether related) of any of the above persons, are NOT eligible to participate in this Sweepstakes or to receive any prize hereunder. Proof of eligibility may be required.
Sweepstakes begins at 12:00:01 pm Pacific Time ("PT") on Aug.22/08 and ends at 11:59:59 pm PT on Sept. 26/08 (the "Sweepstakes Period"). Limit of two (2) entries per person (as determined by email address account holder) for the entire duration of the Sweepstakes Period regardless of entry method. In the event that any Sweepstakes participant exceeds this Sweepstakes entry limit, then all entries submitted by such participant will be deemed void, and such participant will become ineligible to receive any prize in this Sweepstakes, except as follows: If an entrant purchases more than two downloadable PopCap games during the Sweepstakes Period (see Rule 3, below) s/he will receive no further Sweepstakes entries for purchases beyond the first two, but entries received via his/her prior two purchases will not be rendered void, and will be included in the prize drawing. Proof of entry submission will not be deemed proof of receipt of such entry by Sponsor or Administrator.
Two ways to enter the Sweepstakes. To enter without purchase, each participant must complete an on-line entry form at http://www.popcap.com/promos/pegglesweepstakes/ with all required information and must submit such completed entry form, in accordance with the instructions on such Web site and herein, for receipt by Administrator within the Sweepstakes Period. To enter with purchase: people who purchase a downloadable PopCap game at www.popcap.com during the Sweepstakes Period, and who are eligible to participate according to these Official Rules, will automatically receive one entry into the Sweepstakes, subject to the maximum number of entries per person noted above. Any Sweepstakes participant who desires to be contacted for future promotional purposes may check the opt-in box on the entry form. All Sweepstakes entry forms and other related materials submitted shall become the exclusive property of Sponsor and shall be neither acknowledged nor returned except as provided herein.
In the event of a dispute as to who submitted a particular Sweepstakes entry via the non-purchase method of entry, such entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided that such person otherwise meets each of the eligibility requirements of these Rules. "Authorized account holder" means the natural person who was assigned an e-mail address by an Internet access provider, service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any potential prize recipient hereunder may be requested to provide proof that he/she is the authorized account holder. In the event of a dispute as to who is entitled to receive a Sweepstakes entry via the purchase method of entry, such entries will be deemed made by the authorized owner of the credit payment account that was used to make the purchase. Sweepstakes Entities hereby specifically reserve the right to invalidate any and all Sweepstakes entries that are made through any robotic, automatic, mechanical, programmed or similar entry duplication method, or through fraud, and to disqualify the individuals using such a method from participating in this Sweepstakes or receiving any prize hereunder. By entering, each participant in this Sweepstakes hereby agrees to irrevocably release, indemnify and hold harmless the Sweepstakes Entities, PopCap Games, Inc., each of their respective advertising, marketing and promotion agencies, and the officers, directors, employees, designees and agents of each of the foregoing (collectively, the "Released Parties"), from and against any and all claims, actions, causes of action, demands, judgments, liability, injuries, damages, losses, costs and expenses (collectively, "Claims") arising out of or relating to, directly or indirectly, in whole or in part, any of the following: (a) participation of entrant (and/or his/her guest, if applicable) in this Sweepstakes or in any Sweepstakes- or prize-related activities (if applicable), including but not limited to travel related thereto; (b) the acceptance, possession or use/misuse of any prize (if applicable) by entrant (and/or his/her guest, if applicable); (c) electronic transmissions or Sweepstakes entries that are lost, late, stolen, incomplete, illegible, indecipherable, inaccurate, damaged, garbled, destroyed, misdirected or not received by Sponsor or Administrator for any reason; (d) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of any Sweepstakes entries, or the destruction of or unauthorized access to, or alteration of, any Sweepstakes entries; (e) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsor's reasonable control that may jeopardize the administration, security, fairness, integrity, safety or proper conduct of this Sweepstakes; (f) the submission of any Sweepstakes entries in a manner that is not expressly allowed under these Rules; (g) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in this Sweepstakes; (h) any typographical or other error in any printing or advertising related to this Sweepstakes, in the administration or execution of this Sweepstakes, or in the announcement of prizes/prize winners; or (i) cheating or fraud by any participant. SOME JURISDICTIONS, INCLUDING WIHTOUT LIMITATION THE UK, MAY NOT ALLOW SOME OF THE LIMITATIONS OR EXCLUSIONS OF LIABILITY LISTED ABOVE, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR PROHIBITIONS REGARDING SUCH LIMITATIONS AND EXCLUSIONS. All incomplete or otherwise non-conforming Sweepstakes entries will be disqualified from the Sweepstakes and ineligible to receive any prize hereunder. If for any reason this Sweepstakes cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause(s) beyond the control of Sponsor that may corrupt or affect the security, administration, fairness, integrity, safety or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor hereby specifically reserves the right, exercisable at any time thereafter by Sponsor in its sole discretion or by Administrator, on behalf of Sponsor, to terminate, suspend or modify this Sweepstakes. If this Sweepstakes is terminated before the scheduled conclusion date of the Sweepstakes Period as stated herein, then Administrator (or its designee) will select the potential winners of the prizes described below, by means of a random drawing from among all eligible, non-suspect Sweepstakes entries received by Administrator prior to the date and time of such termination. Sweepstakes Entities hereby reserve the right, exercisable at any time in their sole discretion (and without limitation of any and all other legal and/or equitable rights and remedies that may be available), to disqualify from this Sweepstakes and to prosecute any individual(s) who is (are) found to be tampering with or attempting to tamper with the Sweepstakes entry process or any other part of this Sweepstakes. CAUTION: ANY ATTEMPT BY ANY PERSON(S) DELIBERATELY TO DAMAGE ANY WEB SITE OR OTHERWISE TO CORRUPT THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR HEREBY SPECIFICALLY RESERVES THE RIGHT TO DISQUALIFY (FROM THIS SWEEPSTAKES), PROSECUTE AND SEEK DAMAGES FROM AND AGAINST ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
One (1) Grand Prize will be awarded, consisting of a four (4) day/three (3) night trip for two (2) (winner and one guest) to New York City, including two (2) tickets to attend a Broadway play. The Grand Prize includes (a) round-trip, coach-class air transportation, from the major U.S. commercial airport nearest the Grand Prize winner's principal residence (as determined by Sponsor, in its sole discretion). In the event the winner is a resident of Canada or the U.K., the winner and guest shall depart from a major commercial airport nearest the Grand Prize winner's principal residence (as determined by Sponsor, in its sole discretion). (b) three (3) nights accommodations in a standard-size room, on a double occupancy basis, at a hotel selected by Sponsor, in its sole discretion, ground transportation between hotel and airport only, and (c) two (2) tickets to a Broadway play. Play tickets to be obtained by Sponsor, and the selection of which play and which seats is at Sponsor's sole discretion. Spending money is not included in the prize. Approximate Retail Value ("ARV") of Grand Prize package: $5,325(USD). (The prize value is based on departure from Seattle, WA and may vary based on actual point of departure. One (1) First Prize will be awarded, consisting of a Sony - VAIO Laptop with Intel® Core™2 Duo Processor P8400 (Model: VGN-FW139E/H) | (including a library of PopCap games. ARV: $1,850(USD). One (1) Second Prize will be awarded, consisting of an Apple iPod 80GB (Model # MB147LL/A) ARV: $250(USD). Ten (10) Third Prizes will be awarded, each consisting of a Peggle Nights Gold Pack, ARV: $60 (USD) per prize. One hundred (100) Fourth Prizes will be awarded, each consisting of a Peggle Nights Game download. ARV: $20(USD) per prize. Peggle Nights requires a minimum of a 100% Pentium II 700 MHz PC compatible computer; 256 MB RAM; Windows 98, ME, 2000, XP or Vista OS; DirectX7 or better and DirectX certified sound card; and a 16-bit or 32-bit display. Total ARV of all prizes in this Sweepstakes is $10,025(USD). The actual retail value of the Grand Prize may vary, depending upon the city of departure, and the time of travel, and any difference between the stated ARV and the actual retail value of the Grand Prize will not be awarded.
The Grand Prize recipient and his/her guest must travel together on the dates, times and airline(s) to be specified by Sweepstakes Entities. Winner and his/her guest must have, to the extent applicable to them, valid passports, requisite visas, vaccinations or other necessary travel documentation. Travel/accommodations restrictions and black-out dates may apply. Notwithstanding anything contained in Paragraph 5 above, air transportation will not be provided as part of the Grand Prize if the Grand Prize recipient resides within one hundred (100) miles of New York City. If the Grand Prize recipient does reside within one hundred (100) miles of the New York City, then in lieu of air transportation, he/she will receive up to three (3) days' use of a rental car (subject to any and all age and/or other eligibility restrictions that may apply, and not inclusive of gas or any optional insurance coverage), in a size/class and model to be determined by Sponsor (in its sole discretion); no other alternative form(s) of transportation, and no compensation of any kind or amount (e.g., for the difference in value between the air transportation and the rental car) will be provided to the Grand Prize recipient or his/her guest. Twenty-one (21)-day advance booking and a Saturday night stay are required. Travel must be completed by June30/09 under any and all circumstances; If the trip is not or cannot be completed by June30/09, then: (a) the potential Grand Prize recipient will forfeit all rights to receive and use the Grand Prize (and all components thereof); (b) Sweepstakes Entities shall be relieved of any and all further obligations or liability to such potential Grand Prize recipient; and (c) Sweepstakes Entities shall have the right (but not the obligation) to select an alternate potential Grand Prize recipient by means of a subsequent random drawing to be conducted by Administrator (or its designee) from among all remaining eligible Sweepstakes entries received through both entry methods combined. If the guest/travel companion of the Grand Prize recipient is a resident of a jurisdiction that deems him/her to be a minor, then he/she must be accompanied on the Grand Prize trip by his/her parent/legal guardian, who must pay his/her own expenses, including but not limited to transportation and lodging expenses, unless such parent/legal guardian is the actual Grand Prize recipient. The Grand Prize trip may not be combined with any other offer(s), and travel may not qualify for frequent flyer miles. All travel arrangements are subject to availability and must be made through Sponsor's designated agent. All other travel-related and incidental expenses and costs not expressly listed above as one of the components of the Grand Prize, including but not limited to meals, gratuities, ground transfers, other transportation, excursions, insurance, mobile phone service, spending ,money and hotel incidentals, are the sole and full responsibility of the Grand Prize recipient.
Odds of winning a prize depend on the number of eligible entries received through both entry methods combined. Prizes may not be transferred, assigned, redeemed for cash or substituted, except that Sponsor may substitute a prize (or any component thereof) with a different prize (or prize component) of equal or greater value, if the advertised prize (or any component thereof) becomes unavailable. All applicable income taxes in connection with the receipt, possession or use of any prize awarded in this Sweepstakes, if any, are the sole and full responsibility of the prize recipient. Limit of one (1) prize per household. All other details of the prizes that are not set forth specifically above shall be determined at Sponsor's sole discretion. If for any reason a potential prize recipient cannot accept his/her prize in accordance with each of the applicable provisions of these Rules, then (a) such potential prize recipient will forfeit all rights to receive and use the prize (and all components thereof); (b) Sweepstakes Entities shall be relieved of any and all further obligations or liability to such potential prize recipient; and (c) Sweepstakes Entities shall have the right (but not the obligation) to select an alternate potential prize recipient by means of a subsequent random drawing to be conducted by Administrator (or its designee) from among all remaining eligible Sweepstakes entries received through both entry methods combined.
On approximately Sept.30/08, as the means for selecting the potential prize recipients hereunder, Administrator (or its designee) will conduct a random drawing from among all eligible Sweepstakes entries received through both entry methods combined. Administrator is independent of Sponsor, and each of Administrator's decisions in all matters relating to eligibility, prize fulfillment and this Sweepstakes shall be final, binding and non-appealable in all respects. The potential prize recipients must comply fully with each provision of these Official Rules in order to remain eligible to receive their respective prizes. Sweepstakes Entities will attempt to notify the potential prize recipient of his/her selection by means of regular U.S. Mail, telephone, e-mail or other appropriate means within approximately ten (10) days after the date of the above-described drawing. Potential winners who are Canadian residents (if any) must answer a timed multi-part mathematical skill question correctly to claim prizes. If any potential prize recipient is found to be ineligible for any reason; (b) any potential prize recipient fails to comply with each provision of these Official Rules; or (c) the notification to any potential prize recipient is returned as undeliverable, then (i) such potential prize recipient will forfeit all rights to receive and use the prize (and all components thereof), (ii) Sweepstakes Entities shall be relieved of any and all further obligations or liability to such potential prize recipient, and (c) Sweepstakes Entities shall have the right (but not the obligation) to select an alternate potential prize recipient by means of a subsequent random drawing to be conducted by Administrator (or its designee) from among all remaining eligible Sweepstakes entries received through both entry methods combined. The potential Grand Prize recipient and his/her guest/travel companion (or guest's parent or legal guardian if guest is a minor) shall be required to complete, sign and return an Affidavit of Eligibility (applies to the potential Grand Prize recipient only), Liability Release, and (where legal) a Publicity Release, within fourteen (14) days after the date of initial notification of such potential Grand Prize recipient's selection; otherwise, (A) such potential Grand Prize recipient will forfeit all rights to receive and use the Grand Prize (and all components thereof); (B) Sweepstakes Entities shall be relieved of any and all further obligations or liability to such potential Grand Prize recipient; and (c) Sweepstakes Entities shall have the right (but not the obligation) to select an alternate potential Grand Prize recipient by means of a subsequent random drawing to be conducted by Administrator (or its designee) from among all other remaining eligible Sweepstakes entries received through both entry methods combined.
Subject solely to Sponsor's privacy policy at http://www.popcap.com/terms.php#privacy, any potential prize recipient (except a resident of TN) hereby irrevocably agrees that upon his acceptance, receipt or use of the prize, the Sweepstakes Entities may use his/her name, city and state of residence, likeness (photographic or simulated) and/or voice for any and all advertising, marketing, promotion, public relations or other business operations or trade purposes whatsoever, in any and all media (whether now known or hereafter devised) throughout the world, in perpetuity, without any restriction(s), further notice, approval, or further payment of compensation of any kind or amount, except solely to the extent prohibited by applicable law. By participating in this Sweepstakes, each entrant hereby irrevocably agrees to be bound by (i) each provision of these Official Rules and (ii) each decision of the Administrator, which shall be final, binding and non-appealable in all respects.
